Although the use of arbitration has become commonplace in the organizational world, the ethical issues surrounding arbitration have never been fully explored. The paper reviews ethical issues in arbitration, particularly in terms of forensic bias parallels, that may affect decision-making and make the arbitrator''s decision questionable. Finally, the maintenance of fairness in the arbitration process, and the importance of an ethically acceptable system of organizational justice are also discussed.

The duty to protect patient welfare underpins undergraduate medical ethics and patient safety teaching. The current syllabus for patient safety emphasises the significance of organisational contribution to healthcare failures. However, the ongoing over-reliance on whistleblowing disproportionately emphasises individual contributions, alongside promoting a culture of blame and defensiveness among practitioners. Diane Vaughan’s ‘Normalisation of Deviance’ provides a counterpoise to such individualism, describing how signals of potential danger are collectively misinterpreted and incorporated into the accepted margins of safe operation. NoD is an (...) insidious process that often goes unnoticed, thus minimising the efficacy of whistleblowing as a defence against inevitable disaster. In this paper, we illustrate what can be learnt by greater attention to the collective, organisational contributions to healthcare failings by applying NoD to The Morecambe Bay Investigation. By focusing on a cluster of five ‘serious untoward incidents’ occurring in 2008, we describe a cycle of NoD affecting trust handling of events that allowed poor standards of care to persist for several years, before concluding with a poignant example of the limitations of whistleblowing, whereby the raising of concerns by a senior consultant failed to generate a response at trust board level. We suggest that greater space in medical education is needed to develop a thorough understanding of the cultural and organisational processes that underpin healthcare failures, and that medical education would benefit from integrating the teaching of medical ethics and patient safety to resolve the tension between systems approaches to safety and the individualism of whistleblowing. Professor Brian Goodwin (1931-2007) was a visionary biologist, mathematician and philosopher. Understanding organisms as dynamics wholes, he worked to develop an alternate view to extreme Darwinism based solely on genetic factors. He was a pioneer in the field of theoretical biology.

In this paper, I argue that pragmatism, at least in its formulation by William James, squarely addresses the metaethical and normative issues at the heart of our present crisis in moral justification. James gives ethics an empirical foundation that permits the natural and social sciences a clear role in defining our obligation to the wider environment. Importantly, James’ pragmatism also addresses the psychological and cultural factors that help elicit our willingness to adopt an ethical posture toward life.

We thank the commentators for their thoughtful engagement with our paper.1 In different ways, they make the same substantial point: our suggested interventions are not enough to solve the problems of organisational failure. On this we wholeheartedly agree. Organisational failure in healthcare is complex and multifaceted, it cannot be solved by one intervention in medical education. We did not intend to imply that our proposals alone would solve organisational failure, and this positioning misconstrues the aims of our paper. Sparrow, 1929 While it is commonly accepted that Eu­gene O'Neill studied Oriental mystical religions and that this study may be detected in some of his less successful experimental plays (Lazarus Laughed, The Fountain, Marco Millions) there has not been an (...) effort to con­sider systematically his "immense interest" and the influence it had on O'Neill's thought and writing. Robinson explores the tension between Occidental and Oriental elements in the playwright's art, examining both the sources of the conflict and its manifestation in selected plays written between 1916and 1942. Through an examination of O'Neill's cor­respondence, research library, and manuscript materials (some of which have pre­viously been unavailable for study) Robinson is able to reveal the origins of O'Neill's Ori­entalism. An easy familiarity with the com­plex interrelationships of Eastern and West­ern religions and the Oriental thought that underlies the ideas of many Western philoso­phers, allows Robinson to address the in­tricate problem of Oriental influences on O'Neill's favorite Western sources, including Nietzsche, Schopenhauer, Jung, Strindberg, and Emerson. Finally in a play-by-play exegesis, Robin­son traces the course of O'Neill's mysticism from its apparent repudiation in the deeply flawed Dynamo to its synthesis in The Iceman Cometh, Long Day's Journey Into Night, and Hughie, where Eastern ideas of maya, dy­namic polarity, and the emptiness of the uni­verse are again evident. In 1896 William James published an essay entitled The Will to Believe, in which he defended the legitimacy of religious faith against the attacks of such champions of scientific method as W.K. Clifford and Thomas Huxley. James's work quickly became one of the most important writings in the philosophy of religious belief. James Wernham analyses James's arguments, discusses his relation to Pascal and Renouvier, and considers the interpretations, and misinterpretations, of James's major critics. Wernham shows (...) convincingly that James was unaware of many destructive ambiguitities in his own doctrines and arguments, although clear and consistent in his view that our obligation to believe in theism is not a moral but a prudential obligation -- a foolish-not-to-believe doctrine, rather than a not-immoral-to-believe one. Wernham also shows that the doctrine is best read as affirming the wisdom of gambling that God exists, a notion which James failed to distinguish from believing and which, among other things, he explicitly identified with faith. James's pragmatism, a theory concerning the meaning of truth, is shown to be quite distinct from the doctrine of The Will to Believe. In concentrating on a careful analysis of this doctrine of the will-to-believe, Wernham not only makes a major contribution to understanding James's philosophy, but also clarifies issues in the philosophy of religion and in the analysis of belief and faith. Nelson, Ph.D., and I co-direct.The Veterans Health AdministrationThe Department of Veterans Affairs operates 171 hospitals providing services ranging from primary, secondary, and tertiary medical care to psychiatric hospitals, rehabilitation centers, and nursing homes. The purpose of this study was to determine whether the ethical climate dimensions identified by Victor and Cullen (1987, 1988) could be replicated in the subunits of a multi-unit organization and if so, were the dimensions associated with particular types of operating units. We identified three of the dimensions of ethical climate found by Victor and Cullen and also found a new dimension of ethical climate related to service. Partial support was found for Victor and Cullen's hypothesis that certain ethical (...) climate dimensions are associated with particular forms of organizational governance and control. (shrink)

Physics is oth the most fundamental and the most general science of nature. All natural processes, from the motion of planets to the division (...) of cells, are governed by, but not only by, laws of physics. Similarly, the semiotic of John Poinsot (traditionally known by his Dominican name, John of St. Thomas) is the most fundamental and general science of signs. The actions of all signs -from natural signs such as footprints and symptoms of disease, to signs of communication, such as logical operators and linguistic signs, to signs in cognition, such as concepts and percepts -are governed by, but not only by, the fundamental relational logic of semiosis set forth in his Ars Logica [1632]. If C. S. It is a truth of military history that major battles are not clearly understood by the rank-and-file who are embroiled in them. There is a flurry of activity, a “blooming, buzzing confusion,” and anything that moves in the surrounding terrain is likely to be identified as the enemy. Usually it is only after the “tumult and the shouting dies” that a clear picture emerges, and a tally can be obtained of how many of one’s friends were felled by mistake.

The _Philebus _is the only Platonic dialogue that takes as its central theme the fundamental Socratic question of the good, understood as that which makes for the best or happiest life. This predominantly ethical theme not only involves an extended psychological and epistemological investigation of topics such as sensation, memory, desire, anticipation, the truth and falsity of pleasures, and types and gradations of knowledge, but also a methodological exposition of dialectic and a metaphysical schema, found nowhere else in the dialogues, (...) that is intended to illuminate the nature of mixture. In its interweaving of ethical, metaphysical, and epistemological topics, the _Philebus_ offers a unique opportunity to assess the relation of these topics in Plato’s mature thought and so to gain insight into his philosophical vision as a whole. Posterior parietal cortex has traditionally been considered to be a sensory association area in which higher-order processing and intermodal integration of incoming sensory information occurs. In this paper, evidence from clinical reports and from lesion and behavioral-electrophysiological experiments using monkeys is reviewed and discussed in relation to the overall functional organization of posterior parietal association cortex, and particularly with respect to a proposed posterior parietal mechanism concerned with the initiation and control of certain classes of eye and limb movements. Preliminary (...) data from studies of the effects of posterior parietal lesions on oculomotor control in monkeys are reported.The behavioral effects of lesions of posterior parietal cortex in monkeys have been found to be similar to those which follow analogous damage of the minor hemisphere in humans, while behavioral-electrophysiological experiments have disclosed classes of neurons in this area which have functional properties closely related to the behavioral acts that are disrupted by lesions of the area. On the basis of current data from these areas of study, it is proposed that the sensory association model of posterior parietal function is inadequate to account for the complexities of the present evidence. Instead, it now appears that many diverse neural mechanisms are locatedin partin parietal cortex, that some of these mechanisms are involved in sensory processing and perceptual functions, but that others participate in motor control, and that still others are involved in attentional, motivational, or emotional processes. It is further proposed that the elementary units of these various neural mechanisms are distributed within posterior parietal cortex according to the columnar hypothesis of Mountcastle. (shrink)
